The creator or the person claiming to be the owner of the work is eligible to apply for copyright registration in India. The creator of the work can be an individual, company, NGO or any other entity.

The basic protection term of copyright is 60 years while the exact duration largely depends upon the type of the work to be protected. In case of the cinematographic films, sound recordings, photographs, work of international organization the period of 60 years is counted from the year of publication. While in case of original literary, dramatic, artistic or musical work the period of 60 years is counted from the year following the death of the author.
If the copyright is secured in respect of the work the registered owner can legally claim the damages occurred. First of he is required to send the legal notice to the person infringing the work and in case no response is received he can go ahead with the court proceedings.
